Liability Acknowledgement & Service Risk Agreement

Please read this agreement carefully and sign at the bottom to authorize service.

By signing this Liability Acknowledgement & Service Risk Agreement ("Agreement"), the Customer acknowledges and agrees to the following terms regarding services provided by Squeaks Window Cleaning ("Squeaks").

1. Acknowledgement of Existing Property Conditions

Customer acknowledges that windows, screens, frames, tracks, seals, glass, surrounding materials, fixtures, and related surfaces may already contain existing wear, deterioration, defects, damage, or structural weaknesses that may not be visible prior to cleaning.

This includes but is not limited to:

  • Scratched glass
  • Failed seals
  • Cracked or chipped glass
  • Brittle or aged glass
  • Loose panes
  • Oxidized frames
  • Damaged screens
  • Improperly installed windows
  • Water-damaged frames
  • Loose hardware
  • Fragile decorative glass
  • Paint deterioration
  • Existing leaks
  • Previous fabrication debris damage
  • Aging caulking or seals

Customer understands that standard cleaning processes may reveal pre-existing defects that were previously hidden by dirt, oxidation, debris, or buildup.

2. Assumption of Risk

Customer understands and accepts that window cleaning and related services involve inherent risks.

By authorizing Squeaks to perform services, Customer voluntarily accepts all risks associated with the requested services, including risks involving:

  • Scraper usage
  • Steel wool usage
  • Screen removal/reinstallation
  • Pella insert removal/reinstallation
  • Ladder usage near landscaping or structures
  • Water exposure near aging materials
  • Cleaning of fragile, oxidized, damaged, or deteriorated surfaces
  • Movement of window coverings or nearby objects
  • Cleaning of hard water stains, paint, debris, adhesive residue, or construction debris

Customer acknowledges that certain defects or failures may occur during normal service due to the age or condition of the property rather than technician negligence.

3. Release of Liability

To the maximum extent permitted by law, Customer agrees to release, waive, discharge, and hold harmless Squeaks, its owners, employees, contractors, technicians, affiliates, and representatives from any and all claims, liabilities, damages, losses, costs, or expenses arising from or related to:

  • Existing property defects
  • Failure of aged or weakened materials
  • Glass scratching related to pre-existing fabrication debris
  • Cracked or weakened glass
  • Seal failure visibility after cleaning
  • Damage caused by improper prior installation
  • Damage caused by hidden defects
  • Water intrusion from pre-existing failures
  • Screen or clip failure due to age or brittleness
  • Damage associated with approved scraper or steel wool usage
  • Any service specifically authorized by the Customer

Customer agrees that Squeaks shall not be liable for incidental, indirect, consequential, or cosmetic damages related to the condition or age of the property.

4. Scraper & Abrasive Tool Authorization

Customer specifically acknowledges that the use of scrapers, steel wool, walnut pads, or other abrasive tools carries risk.

Customer understands:

  • Fabrication debris may scratch glass during scraper use.
  • Tempered glass may contain hidden defects.
  • Older windows may be more fragile.
  • Existing scratches may become more visible after cleaning.

By signing this Agreement, Customer authorizes Squeaks to use such tools when necessary and releases Squeaks from liability associated with those approved methods unless caused by gross negligence or intentional misconduct.

5. Pella & Specialty Window Disclaimer

Customer understands that certain specialty windows, including Pella insert systems, storm windows, decorative glass, and aging clip systems, may be fragile.

Customer acknowledges:

  • Inserts may already be weakened.
  • Clips may break due to age.
  • Glass may crack if previously stressed.
  • Specialty systems may fail during standard removal.

Customer assumes all risks related to specialty window systems.

6. Customer Responsibility

Customer agrees to:

  • Inform Squeaks of known defects prior to service
  • Remove or secure fragile valuables near work areas
  • Ensure safe access to work areas
  • Identify any surfaces or items they do not want touched
  • Notify Squeaks of specialty or fragile materials before service begins

Squeaks shall not be responsible for undisclosed risks or inaccessible hazards.

7. Limitation of Liability

If Squeaks is found legally liable despite this Agreement, Customer agrees that total liability shall not exceed the amount paid for the specific service giving rise to the claim.

8. No Guarantees Regarding Existing Conditions

Squeaks does not guarantee:

  • Removal of all stains
  • Removal of all hard water damage
  • Restoration of damaged glass
  • Restoration of oxidized frames
  • Repair of failed seals
  • Prevention of future leaks
  • Structural integrity of aging materials

Cleaning may improve visibility of pre-existing conditions.

9. Photography & Documentation

Customer authorizes Squeaks to photograph property conditions before, during, and after service for documentation, quality control, and liability purposes.

10. Electronic Signature Agreement

Customer agrees that electronic signatures, digital approvals, and online acknowledgements shall have the same legal effect as physical signatures.

11. Governing Law

This Agreement shall be governed by the laws of the applicable province/state where services are performed.

12. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

Customer Acknowledgement & Electronic Signature

By signing below, Customer confirms that they:

  • Have read this Agreement
  • Understand the risks involved
  • Had the opportunity to ask questions
  • Voluntarily authorize Squeaks to perform services
  • Agree to release Squeaks from liability as described above
